1) General Terms and Conditions for Employers
§ 1 Scope, Target groups.
1. These General Terms and Conditions (GTC) apply exclusively to all contracts, services and offers of Fasolt Personalvermittlung GmbH in the field of personnel placement to employers/companies/institutions (hereinafter referred to as "client").
2. These terms and conditions do not apply to caregivers, medical professionals, or other applicants (hereinafter referred to as "candidates"). Separate application guidelines and the privacy policy of Fasolt Personalvermittlung GmbH apply to candidates.
3. Any differing, conflicting or supplementary terms and conditions of the client shall only become part of the contract if Fasolt Personalvermittlung GmbH has expressly agreed to their validity in writing.
Section 2 Conclusion of Contract via the Website (optional)
1. The presentation of services on the website of Fasolt Personalvermittlung GmbH does not constitute a legally binding offer, but rather a non-binding invitation to make contact or to submit an inquiry
2. A contract is only concluded when Fasolt Personalvermittlung GmbH confirms the client's request in writing (email is sufficient) or begins providing the service.
3. The client can view, save and print these terms and conditions via the website before concluding the contract.
§ 3 Principles of fair recruitment / RAL quality mark
1. The contractor acts in accordance with the principles of Fasolt Personalvermittlung GmbH, which comply with the requirements of the RAL quality mark “Fair recruitment of care workers in Germany” (RAL-GZ 912).
2. The client accepts these principles and undertakes to act in accordance with them within the framework of the cooperation.
3. The client is obliged to maintain a target-group-oriented integration management for placed candidates in written form.
4. The client undertakes not to demand any repayments, fees, or other costs from candidates at any time. The employer pays principle applies.
5. The contractor is entitled to verify compliance with the principles set out in this section at any time, a) generally (general right of inspection) and/or b) on a case-by-case basis (case-specific right of inspection). The client will provide the necessary information and evidence for this purpose.
6. A breach of the principles set out in this section constitutes an important reason for extraordinary termination by the contractor.
2) General Terms and Conditions (GTC) for Applicants
- Information for Nursing Staff & Medical Personnel
§ 1 Subject of the mediation
(1) Fasolt Personalvermittlung GmbH (hereinafter referred to as “Fasolt”) specializes in the placement of nursing staff and medical professionals with employers and institutions.
(2) Fasolt supports applicants throughout the entire application process, establishes contact with suitable employers and accompanies the coordination until a possible hiring.
(3) Fasolt acts solely as an intermediary. No employment relationship is established with Fasolt, but exclusively between the applicant and the respective employer.
§ 2 Principles of fair recruitment
(1) Fasolt operates in accordance with the principles of the RAL quality mark “Fair recruitment of nursing staff in Germany” (RAL-GZ 912).
(2) The mediation process shall be transparent, voluntary, respectful and non-discriminatory.
(3) Applicants shall receive clear and complete information on job offers, working conditions and the placement process.
(4) Application documents will only be forwarded to employers with the prior consent of the applicants. Applicants' decisions will be respected at all times.
§ 3 Free of charge for mediation
(1) Fasolt's placement services are completely free of charge for applicants.
(2) Applying for or using the services does not create any payment obligation to Fasolt.
§ 4 Procedure of the mediation
(1) Fasolt informs applicants about migration, recognition procedures and working and living conditions in Germany.
(2) Applicants shall submit their application documents and relevant information (e.g. qualifications, availability, preferred region).
(3) Fasolt reviews the documents and discusses suitable job offers with the applicants.
(4) The individual wishes of the applicants will be compared with the offers received from the employers.
(5) With explicit consent, the applicant profiles will be forwarded to suitable employers and interviews and further steps will be coordinated.
(6) An employment contract shall be concluded directly between the applicant and the employer, provided both parties agree.
(7) The recognition procedure may be carried out via a knowledge test or an adaptation course.
§ 5 Obligations of applicants to cooperate
(1) Applicants undertake to provide complete and truthful information about themselves, their qualifications and availability.
(2) Any changes, in particular regarding qualifications, contact details or availability, must be communicated to Fasolt immediately.
(3) Agreed appointments must be reliably kept or cancelled in good time.
§ 6 Confidentiality and Data Protection
(1) All personal data and documents of the applicants will be treated confidentially.
(2) Data will only be shared with employers if this is necessary for placement purposes and/or if the applicant has given their consent.
(3) Further information on the handling of personal data can be found in Fasolt's privacy policy.
§ 7 No guarantee of mediation
(1) Fasolt strives to find the best possible and most suitable match.
(2) However, no guarantee can be given for successful placement or the conclusion of an employment contract.
